Terms and Conditions

These conditions of offer and purchase apply each time one of our registered dealers offer or purchase a car from you, whether the purchase is completed in person, over the telephone by fax email or post. Please read them carefully before agreeing to sell your car to one of our registered dealers. Nothing in these terms and conditions affects the statutory rights of consumers. The site operates in Mainland England, Scotland and Wales. Site visitors from Northern Ireland may use this site but if you wish to accept an offer from one of our registered dealers it is your responsibility to deliver your car to the purchasing motor dealer, unless the registered dealer operates in Northern Ireland.

You need to be eighteen years or older to use this service. You will need to provide our registered dealers with certain information about the car you wish to sell. To offer your car to our network of dealers you must visit www.cashinthegarage.com and give a full and accurate account of your car. Your car will be viewed by our registered dealers for a period of at least 7 days. Our registered dealers will view the information and description and may make an offer for your car. Any offer(s) for your car will be communicated to in the contact method that you selected during your online submission. A condition of your submission is that your report to us by telephone or email the sale of your car to a registered dealer of Cash in the Garage. The Price Quoted by a Subscribing Dealer

The Price quoted by the registered dealer is in £s sterling and is inclusive of United Kingdom VAT where applicable and is valid for the number of days that you agree with them. You are responsible for the disclosure and payment of any duties or any other taxes payable. The price quoted by a registered dealer forms the basis of a "contract", The contract will be formed in full using a Used Car Purchase Invoice (UCPI) by the registered dealer when the dealer views the vehicle at the collection point and pays for the vehicle in the manner agreed with you.

Payment

The registered dealer will after inspection of the car pay the agreed funds to your nominated account in the format stated in your discussions with the registered dealer. You are not expected to release your car to the subscribing dealer until you have verified that the funds have reached your account, although you may wish to make an agreement otherwise.

Your Warranties

You Warrant that; That the information you provide about your car is full and accurate in all respects. You own the car absolutely, i.e. The car is owned by you alone and is not subject to any arrangement with a third party where the third party has an interest in the car (such as a secured loan/hire purchase or leasing arrangement or agreement) unless the arrangement with the third party is capable of transferring ownership of the car to you for settlement in cash in which case (during or after the registered dealer has collected the car) he will pay to such a third party the amount required to release the car from such arrangement and you agree that the price payable to you is reduced by an amount equal to the amount to be paid to such a third party. and you are aged 18 or over

Conditions of the Contract

he Registered Dealers Contract (UCPI) is conditional upon the matters set out below At a time when the registered dealer collects the car you are not in breach of any of the warranties set out above. Any third party described above (Your Warranties) excepts payment from us in exchange for it releasing any interest in the car. Subject to above (Your Warranties) the subscribing dealer is able to confirm to his satisfaction that he will obtain full and unfettered ownership of the car on payment of the price. The car is in the same condition as described to the registered dealer on the on-line form when the offer was made, including being free from any damage not disclosed at that time and the mileage of the car not having increased by an average of more than 40 miles per day following the offer. All statements you have made to the subscribing dealer on the online form and during the course of the process up to and including the contract are accurate in all respects. The subscribing dealer may ask to view the car prior to his collection and subsequent payment. If your car does not match the on-line submission the dealer will want to reduce their offer for your car.

The registered dealer will verify with you why the vehicle does not match your on-line submission.. You may agree with the registered dealer a new sale price if you wish and take any factors into consideration regarding their time and expense. After completion of their Used car Purchase Invoice (UCPI) a contract will be formed between yourself and the registered dealer or their agent. If after a 7 day period of collection the registered dealer finds that any of the above have not been complied with they may treat the contract as repudiated by yourself and return the car to you and demand repayment of all sums paid to you.

Collection

The subscribing dealer will collect the car from you as per the costs outlined within their offer but are unable to warrant that they will not be late.

When the car is collected the subscribing dealer will require

  • All keys and other items needed to fully operate the car
  • The cars service record
  • The cars V5 also known as the log book
  • The cars tax disc, also known as the road fund licence

The title and risk will pass from the seller to the buyer (the registered dealer) when the Used Car Purchase Invoice has been completed and signed by both parties.

Use of your information

We will use the information that we will collect about you and your car during the performance of the contract in accordance with the terms of our privacy policy, a copy of which can be found on the privacy policy link of our website www.cashinthegarage.com. We may share some of your details with bona fida Motor Insurance Companies. You can email us if you do not wish this to be shared.

Companies and liabilities

If you have any queries or complaints you may address them to info@cashinthegarage.com We, our directors, employees and other agents shall not be liable for damages of any kind including without limitation, direct, indirect, special or consequential damages, loss of income or profits, loss of corruption of data, loss of or damage to property or claims of third parties, arising out of or in connection with consumers or subscribing dealers using our service. We do not limit or exclude our liability for death or personal injury caused by our negligence or any rights you may have as a consumer to the extent that such liability and rights may not be limited or excluded under applicable law.

Validity

If any of these conditions of purchase are unenforceable it will not effect the enforceability of the rest of these conditions of purchase.

No Variation or Representation

Other than provided in these conditions of purchase, nothing said by our employees, sub contractors, or subscribing dealers shall amount to a variation of these conditions or about a representation about the nature of business or products.

Third Party Rights

Nothing in these conditions shall give any person who is not a party to t5he contract any benefit or any right to enforce any of the terms of the contract.

Governing Law and Jurisdiction

These conditions shall be deemed to have been formed under and shall be governed and interpreted in accordance with English law. The English courts shall have jurisdiction to hear disputes between us.
